Illinois Divorce Law and Cumberland County Filings

Divorce in Illinois is governed by the Illinois Marriage and Dissolution of Marriage Act (750 ILCS 5/). Illinois allows divorce only on grounds of irreconcilable differences. Fault-based divorce is not an option. Under Section 401(a)(2), a six-month separation is conclusive proof of irreconcilable differences, meaning neither party must prove anything beyond the period of separation.

At least one spouse must have lived in Illinois for 90 days before filing.
